PUBLIC OFFER (AGREEMENT)

on the Sale of Goods in the "YouCanna" Online Store

This agreement is an official and public offer of the Seller to conclude a contract for the sale of Goods presented on the website youcanna.com.ua. This agreement is public (in accordance with Article 633 and Article 641 of the Civil Code of Ukraine), and its terms are identical for all Buyers.

By clicking the "Place Order" button (or any equivalent button) on the checkout page of the online store, the Buyer provides full and unconditional acceptance (accretion) of the terms of this Agreement.

1. GENERAL PROVISIONS AND DEFINITIONS OF TERMS

  • 1.1. Seller — Individual Entrepreneur Rud Halyna Liubomyrivna (registration address: 33 Propellerna St., Lviv, 79052), who sells the Goods presented on the Website.

  • 1.2. Buyer — any legally capable individual or legal entity that has accepted this Public Offer and places an order for personal or business needs.

  • 1.3. Goods — products (oils, cosmetics, isolates, distillates, food products containing CBD, etc.) offered for sale in the online store.

  • 1.4. Online Store (Website) — the official web resource located at the domain name youcanna.com.ua, created to familiarize Buyers with the Goods and to conduct remote sales.

2. SUBJECT OF THE AGREEMENT

  • 2.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement.

  • 2.2. The Buyer confirms that they are familiar with the assortment, properties, dosage, and purpose of the Goods presented on the Website.

3. ORDERING PROCEDURE

  • 3.1. The Buyer independently places an Order on the Website by adding selected Goods to the virtual "Cart" and filling in the required contact information.

  • 3.2. When placing an order, the Buyer undertakes to provide accurate and truthful information: Full Name, phone number, email address, and delivery address.

  • 3.3. An Order is considered confirmed after the Buyer receives a corresponding electronic notification or a call from the store manager.

4. PRICE OF GOODS AND PAYMENT PROCEDURE

  • 4.1. Prices for the Goods are indicated on the pages of the Website in the national currency of Ukraine — Hryvnia (UAH).

  • 4.2. The Seller has the right to unilaterally change the prices of Goods until the Order is placed by the Buyer. Once the Order is confirmed, the price remains unchanged.

  • 4.3. Payment for the Goods can be made by the Buyer:

    • Via 100% prepayment to the Seller's Individual Entrepreneur (FOP) settlement account or through integrated electronic payment systems on the Website.

    • Cash on delivery (payment upon receipt) at the branch of the delivery service.

  • 4.4. Delivery costs are not included in the price of the Goods and are paid by the Buyer separately according to the tariffs of the logistics operator.

5. DELIVERY AND ACCEPTANCE OF GOODS

  • 5.1. Delivery of Goods is carried out throughout the territory of Ukraine by logistics companies (e.g., Nova Poshta) to the address or branch specified by the Buyer.

  • 5.2. The Seller undertakes to send the Goods within the timeframe agreed with the Buyer, but no later than 5 business days from the moment of Order confirmation or payment.

  • 5.3. The risk of accidental loss or damage to the Goods passes to the Buyer from the moment the Goods are handed over to the logistics company.

  • 5.4. The Buyer is obliged to check the integrity, completeness, and appearance of the Goods directly at the delivery service branch or in the presence of the courier. In case of damage, the Buyer must draw up a corresponding Report on the spot.

6. RETURN AND EXCHANGE OF GOODS

  • 6.1. The return and exchange of Goods of proper and improper quality are carried out in accordance with the Law of Ukraine "On Protection of Consumer Rights".

  • 6.2. Important Note: According to the Resolution of the Cabinet of Ministers of Ukraine, certain categories of goods (e.g., perfume and cosmetic products, food products, hygiene items) of proper quality are not subject to return or exchange. The return of CBD oils, capsules, and cosmetics of proper quality is possible exclusively under the condition that the factory seal, integrity of protective labels, packaging, and marketable condition of the product/device are fully preserved.

  • 6.3. In case a manufacturing defect is discovered, the Seller undertakes to replace the Goods or refund the money to the Buyer within 7 banking days from the moment the defective Goods are received back.

7. PROTECTION OF PERSONAL DATA

  • 7.1. By placing an order and accepting this offer, the Buyer gives voluntary consent to the collection, processing, accumulation, and use of their personal data by Individual Entrepreneur Rud Halyna Liubomyrivna in accordance with the Law of Ukraine "On Protection of Personal Data".

  • 7.2. Personal data is used exclusively to fulfill obligations under this Agreement, process payments, deliver Goods, and send informational or marketing messages (with consent).

8. LIABILITY OF THE PARTIES AND DISPUTE RESOLUTION

  • 8.1. For non-fulfillment or improper fulfillment of obligations under this Agreement, the Parties shall be held liable in accordance with the current legislation of Ukraine.

  • 8.2. All disputes arising between the Buyer and the Seller shall be resolved through negotiations. If an agreement cannot be reached, the dispute shall be settled in court in accordance with the legislation of Ukraine.

  • 8.3. The Seller is not liable for improper use of the Goods by the Buyer or for non-compliance with the individual dosage of products containing cannabinoids.

9. TERM OF THE AGREEMENT

  • 9.1. This Agreement enters into force from the moment the offer is accepted by the Buyer and remains valid until the Parties fully perform their obligations.
